Virginia's demerit points are the DMV's business, not the court's. A court decides the fine; the DMV then posts 3, 4 or 6 points for the conviction under the Uniform Demerit Point System in Va. Code § 46.2-492, counts them for two years from the date of the offense, and acts on its own schedule once enough of them arrive — an advisory letter, a required driver improvement clinic, probation, then suspension.
